MANITOBANS PROTESTING PROVINCE’S HOMEGROWN CANNABIS BAN HOPE FOR COURT WIN

A group of around a dozen people protested Manitoba's ban on homegrown cannabis, which was launched in May 2022. The group, TobaGrown, called for the province to lift the ban and adhere to federal government rules surrounding the substance. The group is calling for the province to lift the ban and instead adhere to federal regulations, which went into effect on October 17, 2018, when cannabis use became legalized in Canada. The federal Cannabis Act allows Canadians to grow up to four cannabis plants at a residence at one time, but provincial rules prohibit the growth of cannabis in a home completely. Manitobans can be fined up to $2,542 for not following the ban. The group says that this is not the first time the issue has been raised in a provincial court. In September 2019, the Quebec Superior Court struck down that province's homegrown cannabis ban, ruling it unconstitutional. The group is ready to appeal if they lose. Things always get messy when provincial laws veer away from federal laws and vice versa, so let’s hope for Manitobans that this is all resolved sooner rather than later.
